Terms of Service

This agreement is between you and Alpha Cherry Co., a company headquartered in British Columbia, Canada (hereinafter referred to as “Snap Loyalty”, “the Company”, “we”, “us”, or “our”). By accessing our platform, products, and services (collectively, the “Service”), you are agreeing to be bound by these Terms of Service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this Service.


SMS Usage & Restricted Content

    1. New customers will only receive marketing/promo SMS texts if they have voluntarily opted-in. This doesn’t affect welcome text messages, but for marketing/promo SMS texts (as part of the Complete Subscription plan), customers must first opt-in at https://snaployalty.co
    2. Marketing/promo SMS texts must not contain any external links (i.e. YouTube, Facebook, etc.)
    3. Text messages must not contain any restricted content as defined in the table below. Snap Loyalty accounts sending text messages, including welcome texts, related to these restricted content will be permanently suspended with no refunds given.

Account Registration & Security

To access features, you must register for an account. You may do so by providing an email address and password (“Direct Credentials”) or by using a third-party service (e.g., Google OAuth).

  • Accuracy: You agree to provide accurate, current, and complete information during the registration process.
  • Credential Security: You are solely responsible for maintaining the confidentiality of your credentials. You must not share your login information with third parties. To protect your account, you agree to use a unique, strong password for Snap Loyalty that is not shared with any other service or website. Using a reused password is a significant security risk and may void your protections under these terms.
  • Third-Party Accounts: If you use a third-party service to log in, Snap Loyalty does not store your third-party password. Your security is subject to the protocols of that provider.
  • Responsibility for Activity: You are solely responsible for all activities that occur under your account, whether authorized by you or not.
  • Notification of Breach: You must immediately notify Snap Loyalty of any unauthorized use of your account or any other breach of security. Snap Loyalty will not be liable for any loss or damage arising from your failure to comply with these security obligations.

Business Data & PII Responsibility

As a business user, you may collect and store customer data through the platform, which is strictly limited to: customer first names, phone numbers, and month/day of birth.

  • Data Minimization: You acknowledge that Snap Loyalty is designed for data minimization. We do not collect or store birth years or full surnames. Any entry of birth years, last names, or other unsolicited personal information into fields labeled for “First Name” or “Date of Birth” is done at your own risk and exceeds the intended use of the platform.
  • Consents & Legality: You represent and warrant that you have obtained all necessary consents from your customers to collect and process this specific data. As the Data Controller, the ultimate responsibility for the lawful collection and use of Customer PII rests with you.
  • Security Acknowledgment: While Snap Loyalty employs industry-standard security measures (including encryption of sensitive fields), you acknowledge that no data transmission or storage system is 100% secure. Snap Loyalty acts as a Data Processor on your behalf and is not liable for data loss resulting from unauthorized access to your account or your failure to secure your login credentials.

Use License

This license shall automatically terminate if you violate any of these restrictions and may be terminated by Snap Loyalty at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.


Disclaimer

The materials on Snap Loyalty’s platform are provided on an ‘as is’ basis. Snap Loyalty makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Snap Loyalty does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its application, website or otherwise relating to such materials or on any linked sites.


Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SNAP LOYALTY (ALPHA CHERRY CO.), OR ITS SUPPLIERS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THIS SERVICE.

UNDER NO CIRCUMSTANCES WILL SNAP LOYALTY BE RESPONSIBLE FOR ANY DAMAGE, LOSS, OR INJURY RESULTING FROM HACKING, TAMPERING, OR OTHER UNAUTHORIZED ACCESS OR USE OF THE SERVICE OR YOUR ACCOUNT OR THE INFORMATION CONTAINED THEREIN. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO SNAP LOYALTY (ALPHA CHERRY CO.) IN THE TWELVE (12) MONTHS PRECEDING THE INCIDENT.


Accuracy of materials

The materials appearing on Snap Loyalty’s platform could include technical, typographical, or photographic errors. Snap Loyalty does not warrant that any of the materials on its platform are accurate, complete or current. Snap Loyalty may make changes to the materials contained on its application or website at any time without notice. However Snap Loyalty does not make any commitment to update the materials.


Modifications

Snap Loyalty may revise these terms of service for its platform at any time without notice. By using this application you are agreeing to be bound by the then current version of these terms of service.


Dispute Resolution & Class Action Waiver

YOU AND SNAP LOYALTY AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. By using this service, you voluntarily waive any right to a jury trial or to participate in a class-action lawsuit.


Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein. You irrevocably submit to the exclusive jurisdiction of the courts located in British Columbia, Canada for the resolution of any disputes.


Inactive Accounts

In accordance with our data minimization and storage limitation obligations under the General Data Protection Regulation (GDPR), we do not retain personal data longer than necessary. If a business account has remained inactive for a continuous period of 24 months and no subscription has ever been purchased, we may permanently delete the account and any associated personal data.

For the purpose of this policy, an account is considered inactive if, during the 24-month period no customer activity has been recorded (including loyalty points being earned or redeemed by customers of the business).
